Elder Law

     The National Association of Elder Law Attorneys describes elder law attorneys as

holistic lawyers, dealing with the legal and non-legal problems of their clients by using a multi-disciplinary approach. Geriatric care managers, guardians, social workers and other aging network professionals play an important role in this approach. Our goal: that the broad range of needs are addressed in a holistic fashion so that the social, psychological, medical and financial needs are met, not just the legal needs.

     As a member of this organization, this Law Office endorses this description of elder law attorneys and this approach to the practice of elder law.

     Elder law is an area of law that covers many different fields of law as they coalesce and impact older Americans in a multitude of ways.  Every day there are thousands of seniors and their families who find themselves confronted with issues with which they have no experience until now.  For example,

  • What will happen to the financial circumstances of my spouse when I go into a nursing home?
  • How will long term care be paid for?
  • Who will handle my financial affairs when I  can no longer do that?
  • Am I entitled to any government benefits?
  • Where will my parent live when he or she can no longer safely stay in his home?
  • How can I help ensure that my parent is well cared for when she is in Maryland and I am in Texas.
  • And many more.

     The Law Office focuses on a number of these areas, including:

  • estate and disability planning through the use of wills, trusts, powers of attorney, and other planning documents;
  • medicaid eligibility;
  • guardianships and conservatorships;
  • planning for the preservation of assets so that the well-spouse will not be impoverished by the nursing home placement of the other spouse;
  • probate;
  • retirement planning, including public and private retirement benefits and survivor benefits, with a special emphasis on federal retirement; and
  • housing and nursing home issues.

     The Law Office works with the client -- in concert with other professional when needed -- to address the client's needs in a complete, comprehensive fashion in an effort to bring order to what can often feel like a chaotic and unfamiliar situation.
